Welcome to Boat Trips Costa Rica!
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“the
Guest”) and Boat Trips Costa Rica (“the Company”). By booking or participating in any excursion
with Boat Trips Costa Rica, you expressly agree to abide by these Terms. If you disagree with any
part of these Terms, you should not proceed with your booking. These Terms are governed by the
applicable laws of Costa Rica, and any disputes shall be resolved exclusively in the courts of Costa
Rica
1.1. Payment Terms:
Full payment is required at the time of booking to confirm your reservation. Payments are non
refundable except as expressly provided in these Terms.
1.2. Acknowledgment of Terms:
By completing your booking, you acknowledge that you have read, understood, and agree to these
Terms, including our cancellation and refund policies.
1.3. Chargebacks and Disputes:
You waive your right to initiate chargebacks or payment disputes without prior written
communication with Boat Trips Costa Rica. Any chargebacks filed in violation of this clause will be
contested under applicable laws, and all associated costs, including legal fees, will be charged to the
Guest.
2.1. Private Tours Refund Policy:
• Cancellations made 72+ hours prior to the excursion: Full refund
• Cancellations made less than 72 hours prior to the excursion: 50% charged
• Cancellations made less than 24 hours prior to the excursion: 100% charged
2.2. Shared Tours Refund Policy:
• Cancellations made 24+ hours prior to the excursion: Full refund
• Cancellations made less than 24 hours prior to the excursion: 100% charged
• Illness: Submit a valid medical report for evaluation. Refunds are at the discretion of Boat
Trips Costa Rica.
• No-Show: Guests who fail to appear at the scheduled time and location for any reason,
including transportation delays or personal emergencies, forfeit the full payment.
2.3. Weather-Related Cancellations:
• Excursions operate rain or shine unless Boat Trips Costa Rica determines that weather
conditions pose a safety risk.
• If Boat Trips Costa Rica cancels an excursion for weather-related reasons, Guests will be
offered:
◦ An alternative date, or
◦ A credit voucher valid for 12 months, or
◦ A full refund if the weather conditions make the excursion unsafe to proceed.
3.1. Assumption of Risk:
By participating in any excursion, you acknowledge and accept that all activities carry inherent
risks, including but not limited to physical injury, illness, loss, or damage to personal property.
Participation is at your sole risk.
3.2. Release of Liability:
To the fullest extent permitted by law, Boat Trips Costa Rica and its affiliates, employees, agents,
and contractors are not liable for:
• Personal injuries, accidents, or illnesses.
• Loss or damage to personal belongings.
• Delays, cancellations, or alterations due to weather, mechanical issues, or other unforeseen
circumstances.
3.3. Insurance:
Guests are responsible for obtaining their own travel and medical insurance. Boat Trips Costa Rica
does not provide insurance coverage for any excursions.
Boat Trips Costa Rica is not liable for failure to perform any obligation under these Terms due to
events beyond our reasonable control, including but not limited to acts of God, natural disasters,
strikes, war, civil unrest, government regulations, pandemics, or unforeseen technical issues.
5.1. Changes to Excursions:
Boat Trips Costa Rica reserves the right to modify excursion details, including schedules, departure
times, itineraries, and prices, without prior notice. Such changes do not constitute grounds for a
refund unless they fundamentally alter the nature of the booked excursion.
5.2. Guest Substitutions:
Substituting one Guest for another is not permitted without prior written approval from Boat Trips
Costa Rica.
6.1. Refund Requests:
Refund requests must be submitted in writing within 7 calendar days of the scheduled excursion
date. Requests received after this period will not be considered.
6.2. Dispute Resolution:
Any disputes arising under these Terms must first be addressed through direct communication with
Boat Trips Costa Rica. If a resolution cannot be reached, the matter shall be referred to binding
arbitration in accordance with Costa Rican law.
6.3. Jurisdiction:
By booking with Boat Trips Costa Rica, you agree that any legal claims shall be resolved
exclusively in the courts of Costa Rica.
6.4. Legal Fees:
In the event of a dispute where Boat Trips Costa Rica prevails, you agree to reimburse the Company
for all legal fees, costs, and expenses incurred.
7.1. Data Collection:
Boat Trips Costa Rica collects personal data solely for the purposes of processing bookings and
providing services. By booking with us, you consent to the collection and use of your personal data
in accordance with our Privacy Policy.
7.2. Data Protection:
We do not share your personal data with third parties except as required by law or necessary to
complete your booking.

These Terms are governed by and construed in accordance with the laws of Costa Rica. If any
provision of these Terms is found to be invalid or unenforceable by a court of competent
jurisdiction, the remaining provisions shall remain in full force and effect.
By proceeding with your booking, you confirm:
• You have read and understood these Terms and Conditions.
• You agree to abide by these Terms without exception.
• These Terms constitute the entire agreement between you and Boat Trips Costa Rica.
Boat Trips Costa Rica reserves the right to modify these Terms at any time without prior notice. The
latest version of the Terms will always be available on our website and will supersede all previous
versions.
